1.Limited Liability

AdroitSSD LLC shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of AdroitSSD.com servers. All damages shall be limited to the immediate termination of service.


2. Refund Policy

2.1

If you are not satisfied within your first 90 days we would be happy to provide you with a full refund, please contact our support department who will attempt to rectify the situation. If the problem cannot be fixed and you are unhappy with the service you are entitled to a refund within 90 days. There are no refunds past the 90 days period.

2.2

Refunds are not available for .COM, .NET, .ORG or any other domain names, Domain Transfer In fees, Domain Transfer Out fees, SSL certificates or any other products or services provided by AdroitSSD through other companies.

2.3

No refunds will be made if we terminate your hosting or other services due to violation of terms and services.

2.4

Credit on your account cannot be refunded and must be used for purchases and renewals.

2.5

Accounts purchased under a promotion, with or without a promo code, are excluded from the 90 days money back guarantee.

2.6

Refund is only applicable for Hosting and failure to provide guaranteed service, like unable to provide guaranteed Uptime/ServerLoad/Bandwith/Customer Support.


3. Affiliates

Affiliates may not mask, hide or modify the affiliate link. It must be used as displayed in the client area. You may not spam or advertise in areas or sections of websites that breach the rules of the displaying site. Doing so will result in the link being reported.


4. Billing/Price change/ Cancellation

At this time we bill monthly, quarterly, semi-annually and annually, depending upon the plan. We accept PayPal,Debit/Credit Card. After upon successful payment verification your account will active instantly .

4.1

Generally The amount you pay for hosting will never increase from the date of purchase. AdroitSSD LLC reserve the right to change prices listed on AdroitSSD.com, and the right to increase/decrease the amount of resources given to plans at any time without any notice.

4.2

Any chargebacks against AdroitSSD will occur a $100 chargeback fee.

4.3

Account Cancellation request must be submit before invoice generation(15 days before of expiration date) . Otherwise you've to pay invoice to collect your Data.

4.4

Invoice will generate before 14 days of Expiration Date

4.5

Repeating abuse,email spamming, virus/malware cleaning will incur a fee of $25.(Failure to pay abuse fees by the due date or failure to respond to abuse tickets promptly may result in termination of all services within the account).


5. Late Payments:

5.1

All accounts are billed according to the dates they were activated on. Action for overdue payments:

1-4 Days - No Action Taken

5 Days - Accounts will be suspended (10% or minimum $3 Late fee)

30 Days - Accounts will be terminated. ( Backup will not be available)


5.2

Late Domain Renew fee is 10% or minimum $3 ( After 30 days of expiration it will be queued for deletation)

5.3

No Backup Will be given for Due invoice account.

5.4

If the customer has multiple services, they risk having their other services suspended until all services are paid up to date.


6. Suspension and Termination

You agree to comply with these Terms and Policies. Any violation of, these Terms and Policies or the other rules, regulations or policies your account may suspend or terminate.

Using the Service in a way, which constitutes violation of any applicable statute, law, court order, tariff, regulation, or treaty (including, but not limited to, intellectual property, communications, privacy, criminal and international law)

Using account for Prostition, Escort agency, Errotic massage parlor, Pornography, Offsense audio, video and Still image.

6.3

Fraudulent Sites Virus/Phising/malware/rootkit Activities.

6.4

Assisting in or directly distributing copyrighted material.Pirated Software/Warez (Linking to pirated software is also not allowed, this includes sites such as MegaUpload, RapidShare, etc.)

6.5

Providing fake or incomplete contact details, including name, postal address and telephone number.

6.6

Engaging in harassment, whether through language, frequency, or size of messages, either with email or website content.

6.7

Using the Service for mail bombing/Spamming/Mass mailing.We do not offer php sendmail.

6.8

Using account to any type Personal, Regional, Religious attack and harrasment, buylling is strickly prohibited.

6.9

Using accounts for uploading,downloading,video/audio streaming,file sharing.

6.10

Using accounts for AutoSurf/PTC/PTS/PPC/Gambling/Lottery/Casino/MUDs/RPGs/PBBGs sites

6.11

Banner-Ad services (commercial banner ad rotation)

6.12

Using a hosting account as a backup/storage device is not permitted

6.13

High-Yield Interest Programs (HYIP) or Related Sites

6.14

We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.Failure to respond to email from our abuse department within 48 hours may result in the termination of your services. All abuse issues must be dealt with via trouble ticket/email and will have a response within 48 hours.


7. Resource Usage

User may not (violation can result in account suspension):

7.1

Use 20% of system resources for longer then 120 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.

7.2

Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.

7.3

Run any software that interfaces with an IRC (Internet Relay Chat) network.
7.4

Run any bit torrent application, tracker, or client.
7.5

Run rapidleech plug mod.

7.6

Participate in any file-sharing/peer-to-peer activities.

7.7

Run any gaming servers such as counter-strike, half-life, battlefield1492, etc.

7.8

Run cron entries with intervals of less than 4 hours.

7.9

Send 25 more emails per hour (50 emails per day).

7.10

Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.

7.11

Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.


8. Backups

AdroitSSD take remote backup and backups are not guaranteed. These backups are strictly for our own use in-case of a server failure, or any emergency. AdroitSSD recommends that clients should backup their data to their personal computers or storage servers. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on AdroitSSD servers.

8.1

Suspended (due to violation of Terms of Services) Account backup may available by paying $25.00 fee. ( Copyright/trademark/Patent Infringement, virus/phishing/hacking script, pornography,harmful content will be deleted)


9. Report Abuse Policy/DMCA

We have a zero tolerance spam policy. We monitor the use of our system and services to ensure they are not used for the purpose of sending out unsolicited email. Please use this submission form to enter any issues regarding spam and the use of our services. Your message will be evaluated for merit and acted on where appropriate, and therefore, we reserve the right to use your notice to substantiate the abuse to our customer. We have also taken measures to prevent the abuse of our registration engine, web hosting, and DNS services at a transactions point of origin in an effort to contribute our part to the elimination of spam. Please note that due to the volume of complaints received, unless we need additional information, you will not receive a reply or update from us. Please be assured that we take abuse very seriously and investigate every incident that is reported. Report abuses to abuse@adroitssd.com


10. Account Migration

10.1 We'll migrate your account to us at charge of free. Your old account should be Cpanel and this migration is only applied for new purchase and once per account.The free transfer services are only available if your previous hosting company is running cPanel.We transfer only your full cPanel account not a single website.

11. Changes to the TOS

AdroitSSD reserves the right to revise its policies at any time without notice.


12. Disclosure to Law Enforcement

AdroitSSD may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.


13. SLA Uptime Conditions

13.1

We commercially advertise 99.95% uptime for our hosting services and committed to provide that, if so our service drops below 99.95% up-time means 21.56 minutes downtime (excluding schedule maintenance) in any given month, you may receive up to 100% credit the amount you paid. This must be claimed within 5 days of our monitoring dropping below this level. To request a credit, please contact billing@adroitssd.com with justification. Service Credits shall not entitle Client to any refund or other payment from AdroitSSD. Service Credits may not be transferred or applied to any other account.

Upto 21.56 minutes downtime in a Month - No Credit.

Upto 43.8 minutes downtime in a Month - 25% credit of Monthly Service fee.

Upto 86.23 minutes downtime in a month - 50% credit of Monthly Service fee.

Upto 131.29 minutes downtime in a month - 75% credit of Monthly Service fee.

Upto 175.19 minutes downtime in a month - 100% credit of Monthly Service fee.

Note: Credit excluded from schedule Maintenance.


13.2

Up-time status is only monitor by our status page and monitors only.


13.3

Support Ticket SLA initial response time is 4 hours and resolution SLA is 36 hours.
